3. Service Engagement & Scope

All services provided by RD Webart Solutions — including website development, digital marketing, branding, software development, app development, SEO, paid advertising, and virtual assistant services — will be governed by a formal proposal, quotation, or agreement outlining:

  • Project scope

  • Deliverables

  • Timeline

  • Payment structure

By approving a proposal or making payment, you agree to:

  • Provide accurate and complete information

  • Cooperate during the project lifecycle

  • Adhere to agreed timelines for approvals and feedback

  • Make payments as per the agreed schedule

Failure to comply may result in project delays or suspension.

4. Pricing & Payments

  • All pricing is quoted in INR (₹) or USD ($), unless stated otherwise.

  • Applicable taxes (including GST) will be charged as required by law.

  • Payments must be made as per the agreed invoicing cycle.

  • Delayed payments beyond 7 business days may result in temporary suspension of services.

Unless explicitly mentioned in our Refund Policy, payments made are non-refundable.

5. Intellectual Property Rights

Unless otherwise agreed in writing:

  • All designs, source codes, graphics, strategies, and digital assets created by RD Webart Solutions remain our intellectual property until full payment is received.

  • Upon full and final payment, ownership of approved deliverables is transferred to the client.

  • Unauthorized use, resale, reproduction, or modification of our work without permission is strictly prohibited.

We reserve the right to showcase completed projects in our portfolio unless otherwise agreed.

6. Client Responsibilities

Clients agree to:

  • Provide clear project requirements

  • Respond to communication and approvals within agreed timelines

  • Avoid unlawful, unethical, or fraudulent use of services

  • Maintain backups of important files or data

We reserve the right to terminate services if misuse, fraud, or policy violations are identified.

7. Confidentiality & Data Protection

Both parties agree to maintain confidentiality of proprietary information shared during the project.

We implement reasonable security measures to protect client data, including:

  • Secure hosting environments

  • SSL encryption

  • Controlled internal access

However, we cannot guarantee absolute security against unforeseen cyber threats or third-party breaches.

8. Third-Party Platforms & Tools

Many services rely on third-party platforms such as:

  • Google Ads

  • Meta (Facebook/Instagram)

  • Hosting providers

  • Payment gateways

  • CRM and marketing tools

RD Webart Solutions is not responsible for:

  • Downtime or disruptions caused by third-party services

  • Account suspensions due to platform policy violations

  • Changes in pricing or terms of those platforms

Clients must comply with the policies of any third-party platform connected to their project.

9. Disclaimer & Limitation of Liability

Our services are provided on an “as available” basis.

We do not guarantee:

  • 100% uninterrupted or error-free services

  • Specific ranking or revenue outcomes from SEO or marketing

  • Immunity from external algorithm or policy changes

RD Webart Solutions shall not be liable for:

  • Indirect or consequential losses

  • Loss of profits or business opportunities

  • Data loss due to external factors

Our maximum liability is limited to the value of the service purchased.

10. Modifications to Terms

We reserve the right to update or modify these Terms at any time. Updated versions will be posted on our website.

Continued use of our services after changes are published constitutes acceptance of the revised Terms.

11. Termination of Services

We may suspend or terminate services if:

  • There is a breach of these Terms

  • Payment obligations are not met

  • Fraudulent or unlawful activities are detected

Upon termination, access to certain files, accounts, or systems may be restricted. Clients are responsible for maintaining their own backups.

12. Governing Law & Jurisdiction

These Terms shall be governed by and interpreted under the laws of India.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Delhi, India.
